Introductory Provisions

These Terms of Use govern the use of the website available at https://hnojiva.cz, including all subpages and content thereof (hereinafter referred to as the “Website”).

The operator of the Website is HOKR, spol. s r.o. (hereinafter referred to as the “Operator”). Further identification and contact details of the Operator are available in the Impressum.

By using the Website, the user acknowledges these Terms of Use and agrees to comply with applicable laws and regulations and to respect the rights of the Operator and third parties.

Copyright and Other Intellectual Property Rights

The Website as a whole and its individual components, including in particular texts, photographs, illustrations, graphic elements, logos, databases, documents, videos and other content, may be protected by copyright, database rights, trademark rights or other intellectual property rights to the extent provided by applicable law.

Unless otherwise stated for specific content, the relevant rights are owned by the Operator or the Operator is otherwise entitled to use such content under a licence or other legal basis.

The content of the Website may be used only to the extent permitted by Act No. 121/2000 Coll., the Copyright Act, as amended, and other applicable laws and regulations.

Without the Operator’s prior written consent, the content of the Website may not, beyond the scope of rights permitted by law, be reproduced, modified, processed, published, distributed, used for commercial purposes, incorporated into other databases or otherwise made available to third parties.

Likewise, systematic or automated extraction, copying or reproduction of substantial parts of the Website’s content is prohibited without the appropriate authorization, unless such use is permitted by applicable law.

Nothing in these provisions affects statutory exceptions, statutory licences or other limitations of intellectual property rights provided for by applicable law.

Third-Party Content

Where the Website contains materials whose author or rights holder is not the Operator, the rights of third parties are respected and such content is used on the basis of the appropriate authorization or within the limits permitted by applicable law.

If you believe that any content published on the Website unlawfully infringes your copyright, trademark rights, personality rights or other rights, please notify us at hnojiva@hnojiva.cz.

Your notification should contain sufficient information to identify the relevant content and describe the right you believe has been infringed. The Operator will review substantiated notifications without undue delay and take appropriate action where necessary.

Accuracy and Nature of Information

The Operator takes reasonable care to ensure that the information published on the Website is accurate and up to date. However, due to the nature of websites and online content, the Website may contain errors, inaccuracies, incomplete information or information that is no longer current.

General professional, commercial or editorial information published on the Website does not, in itself, constitute individual professional, agronomic, technical, legal, tax or other advice.

Where a decision may have significant economic, legal or technical consequences, users should also verify the relevant information against current legislation, technical documentation, product labels, safety data sheets or other authoritative or professional sources.

Nothing in this provision affects any information, product characteristics, obligations or liability of the Operator arising from a contract or from applicable law where such liability or obligations cannot be excluded or limited by agreement.

Availability and Functionality of the Website

The Operator endeavours to ensure the proper and continuous availability of the Website but cannot guarantee uninterrupted or error-free operation.

The operation of the Website may be temporarily restricted or interrupted, in particular due to maintenance, updates, technical failures, outages of third-party services, cybersecurity incidents or other circumstances beyond the Operator’s reasonable control.

The Operator shall not be liable for any loss or damage caused by the unavailability or limited functionality of the Website to the extent that such liability may be excluded or limited under applicable law.

Links to Third-Party Websites

The Website may contain links to websites, services or other resources operated by third parties.

The Operator has no control over their current content, availability, security or terms of use and shall not be liable for them to the extent permitted by applicable law.

The inclusion of a link does not in itself mean that the Operator endorses or recommends the content, opinions, products or services of the relevant third party.

When visiting third-party websites, users are subject to the terms of use and privacy policies of those third parties.

Liability

Each user shall use the Website appropriately and shall be responsible for their own actions when using it.

The Operator shall not be liable for any loss or damage arising from the use of the Website or information published on it where such liability may be excluded or limited under applicable law.

Nothing in these Terms of Use excludes or limits the Operator’s liability where such exclusion or limitation would be prohibited by applicable law, in particular in respect of damage caused intentionally or through gross negligence, or in respect of statutory rights of consumers or other legally protected weaker parties.

Governing Law

Legal relationships arising in connection with the use of the Website shall be governed by the laws of the Czech Republic, unless otherwise provided by mandatory provisions of applicable law or directly applicable European Union legislation.

This does not affect the rights of consumers arising under provisions of law that cannot be excluded by agreement, nor the rules governing the international jurisdiction of courts.

Amendments to the Terms

The Operator may reasonably update or amend these Terms of Use, in particular in response to changes in applicable law, the functionality of the Website or the manner in which it is operated.

The current version of these Terms of Use will always be published on this page and shall become effective on the date stated herein, unless otherwise specified.
