Privacy Policy and Personal Data Processing Statement

With this statement, HOKR, spol. s r.o. hereby informs you of the methods used to process your personal data and the measures taken to ensure its security, as well as your rights related to the processing of your personal data. These rights arise primarily from Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as the "Regulation"), and other legal regulations of the Czech Republic.
1. Personal Data Controller
The personal data controller is HOKR, spol. s r.o., with its registered office at Smilova 485, Zelené Předměstí, 530 02 Pardubice, ID No. (IČ): 00580295, registered in the Commercial Register maintained by the Regional Court in Hradec Králové under file number C 121.
We obtain, collect, record, store, and, in justified cases, provide your personal data to third parties. We obtain your personal data primarily in the following cases:
- a) Ordering goods or services from our portfolio Including via the web presentation at
https://hokr.cz or via the e-shop at https://hnojiva.cz (or https://hnojiva.sk). In such cases, you provide us primarily with identification data (e.g., name, surname, address, and ID number) and other data necessary for the conclusion of a contract, acceptance of an order, registration on the company's e-shop, etc. - b) Communication with the company This includes all communication with our company, e.g., for the purpose of a non-binding inquiry for goods or services, communication regarding the delivery of purchased goods, negotiations on payment terms, complaints and claims procedures, etc. This communication may occur by telephone, in writing, or electronically (including the use of the contact form on our websites).
2. Legal Basis for Processing Personal Data
The company processes your personal data based on the following legal grounds:
- a) Performance of a Contract: To identify you so that the relevant contract can be concluded and all subsequent obligations fulfilled. This also includes negotiations prior to the conclusion of a contract (e.g., placing goods in a shopping cart).
- b) Compliance with a Legal Obligation: When required by law (e.g., accounting, tax regulations, or specific regulations regarding products like precursors to explosives).
- c) Legitimate Interest: When processing is not required by law or contract but is a legitimate interest of our company (e.g., offering similar goods to existing customers via newsletters).
- d) Consent: If no other legal ground applies, we process data solely based on your consent (e.g., voluntary subscription to a newsletter). Consent can be withdrawn at any time.
- e) Public Interest: E.g., if documents containing personal data are requested by public authorities in the exercise of their powers.
Categories of data processed:
- Identification data: Name, surname, academic title, date of birth, address, email, telephone, website, job title, and for companies: ID (IČ), VAT (DIČ), registered office, and branch addresses.
- Data on previous business relations: Information on concluded purchase contracts and types of goods purchased.
3. Data Portability and Transfer
We do not, as a rule, transfer your personal data to third parties. Exceptions occur only when authorized by law, legitimate interest, or necessary for contract performance. This may include providers of:
- Accounting and tax advisory services
- IT and legal services
- Postal and courier services
4. Retention of Personal Data
We retain data for the strictly necessary duration:
- Legal/Contractual obligations: As specified by law (e.g., archiving of tax documents).
- Consent: For the duration of the consent (generally 5 years or until withdrawal).
- Legitimate interest: For the duration of the interest plus an additional 4 years.
5. Obligation to Provide Data
Providing data is entirely voluntary. However, please note that without the necessary data for a contract, legal obligation, or legitimate interest, it is impossible to provide the requested goods or services.
6. Your Rights
In accordance with the Regulation, you have the following rights:
- a) Right of access: To know if and how your data is processed.
- b) Right to rectification: To have inaccurate or incomplete data corrected.
- c) Right to erasure (Right to be forgotten): To have data deleted if the purpose has ended, consent is withdrawn, or processing is unlawful (unless processing is a legal requirement).
- d) Right to restriction of processing: To limit processing under specific conditions (e.g., during a correction process).
- e) Right to data portability: To receive your data in a machine-readable format (if processed automatically via consent or contract).
- f) Right to object: To object to processing based on legitimate interest or for direct marketing.
- g) Right to withdraw consent: You may withdraw consent at any time, preferably via the contact email above.
7. Supervisory Authority
Personal data processing is supervised by the Office for Personal Data Protection (Úřad pro ochranu osobních údajů), Pplk. Sochora 27, 170 00 Prague 7. You have the right to lodge a complaint with this authority.
